Dismiss the lawsuit, she's got no proof '- Usher responds to $20m Herpes suit filed by his plus- size accuser

Singer, Usher wants the $20m herpes lawsuit filed by his plus- size accuser dismissed because she has no proof that he infected her.
In Usher's legal documents, obtained by TMZ, he notes her lawsuit says nothing about whether she had been tested prior to their alleged sexual encounter. 
The singer, who didn't deny claims that he has the disease, said she could have contracted the STD after their alleged encounter.
“A previous sexual partner very well may have already infected her,” he said in the documents filed in court, adding that the Georgia woman put herself at risk of getting the disease by having “casual, unprotected sexual intercourse and/or oral sex.”
Usher who's also planning a lawsuit against everyone involved in the case, is requesting the dismissal of the $20m lawsuit.
